Article 4 - ProcOrdering procedure and terms

In the event of non-payment for any reason whatsoever, a lump-sum payment of 15 € will be demandedby Chabi Chic in addition to the amount of the invoice, plus the cost of debitby Chabi Chic's banking institution in the event ofù amicable collection has been unsuccessful within 10 days from the date of dispatch of the first letter requesting collection, whether this letter is sent by by registeredor by ordinary letter. The order is binding for the Customer as soon as the order is validated, subject to the Customer's right of withdrawal. "right of withdrawal " which may be exercised within fourteen (14) calendar days from the date of receipt or collection of the Order. In the event thatù this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

The customer is responsible for the cost of returning the goods following the exercise of the right of withdrawal.

Items returnedin in new condition will be reimbursed within fourteen days, minus the first shipping costs incurred by the customer who renounces the purchase, plus a 2 EUR processing fee.

The validation of the order by the Customer and its payment lead to receipt of a confirmation email sent by Chabi Chic to the e-mail address indicated by the Customer.

4.3 - Order tracking and delivery

The Customer chooses a delivery address that must be located in France or abroad.France or abroad. The Customer is solely responsible for any failure to deliver due to a lack of information when placing the Order.

 

The seller will provide the customer with a tracking number so that he can follow the progress of his order.

Delivery to Morocco:

Delivery is carried out by the competent services of the company Aramex.

Except in cases of force majeure, delivery times will be within the limits of available stocks, from 24h to 72h afterès validation of the order. Chabi Chic reserves the right to choose the carrier and guarantees the correct delivery of the products. The risks of transport are the responsibility of the Internet user from the moment the product leaves the warehouse.

The Internet user is required to check the condition of the packaging and the conformity of the product delivered, and to note any reservations on the carrier's delivery slip.

Home delivery is not guaranteed for all cities in Morocco (only major cities).

 

Delivery in France and the rest of the world:

Chabi Chic will do its best to ensure that the order is prepared and delivered to the carrier within an average of one (2) to five (10) working days from the day following the buyer's validation of his order.

Chabi Chic shall not be liable for the total or partial non-performance of its obligations under the present contract, if such non-performance is caused by an event constituting force majeure, recognized as such by jurisprudence.

The Parties agree that they shall consult each other as soon as possible in order to determine together how the order will be carried out during the period of force majeure.

After a period of one (1) month of interruption due to force majeure, the parties will be released from their obligations to each other. 

ARTICLE 7.3 - PARTIAL INVALIDITY :

If one or more provisions of these general terms and conditions of sale are held to be invalid or unenforceable, the seller shall be entitled to claim damages.claras such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.e.

ARTICLE 7.4 - ENTIRE CONTRACT :

ARTICLE 7.5 - APPLICABLE LAW-JURISDICTION :

The present general conditions of sale are governed by Moroccan law. For all disputes relating to the present contract between Chabi Chic and an Internet user, the Commercial Court of Marrakech shall have sole jurisdiction.
